Amazon Ends Use of NDAs for Data Center Agreements

Amazon has declared an end to its practice of using non-disclosure agreements (NDAs) with county officials for its data center projects. The company stated this change aims to increase transparency amidst growing public scrutiny.

In addition to discontinuing NDAs, Amazon committed to investing $1 billion over the next five years in communities hosting its data centers. These funds are designated for initiatives such as free community college programs, workforce training, and energy efficiency upgrades for local buildings.

CEO Matt Garman acknowledged in a blog post that widespread opposition to data center construction and potential moratoriums could hinder the development of artificial intelligence. He warned that if such measures are enacted, the U.S. could lose its competitive edge in the AI race.

NDAs have been a significant point of contention, as they have often prevented local officials from disclosing crucial project details, including energy and water consumption and the identity of the companies involved. Legislative efforts at both state and federal levels are underway to ban or restrict the use of such agreements in the data center industry.
