The Entertainment Software Association (ESA), a trade group representing major video game publishers, has asked the U.S. Trade Representative (USTR) to add Anbernic to its list of "Notorious Markets." The association alleges that Anbernic devices facilitate substantial copyright piracy.

ESA claims that Anbernic handheld devices, popular for retro game emulation, are frequently sold with preloaded memory cards containing thousands of unauthorized game copies. While Anbernic does not appear to offer such preloaded cards directly from its website, the ESA argues that sales through "normal retail channels" normalize hardware-based piracy.

The trade group classifies these devices as "superfakes," a designation for high-quality counterfeit trademark goods sold on a commercial scale that enable piracy. Anbernic manufactures Android-based handhelds popular for playing emulated games.

The ESA's request was submitted to the USTR last week. Inclusion on the Notorious Markets list can subject companies to increased scrutiny and pressure to curb infringing activities.
