Apple's Minor Error in OpenAI Lawsuit Could Affect Case Outcome
Apple recently sued OpenAI for trade secret misappropriation. However, a factual error in the lawsuit regarding communication with OpenAI may impact the case's trajectory.

Apple initiated a lawsuit against OpenAI last week, accusing the artificial intelligence company of misappropriating trade secrets related to product design, manufacturing processes, and supply chain strategies. The suit alleges that OpenAI collaborated with departing Apple employees to acquire confidential information beneficial to its hardware development.
However, one assertion within Apple's complaint has drawn scrutiny from legal experts. While the filing stated that OpenAI had not responded to Apple's outreach in February, emails reviewed by NBC suggest that a response was indeed sent.
According to the correspondence, Apple's external legal counsel reportedly confused the names and email addresses of two OpenAI employees, resulting in the missed communication. This identification error could potentially weaken Apple's legal standing in the case.
The lawsuit also names former Apple employee Chang Liu, now at OpenAI, and Tang Yew Tan, formerly Apple's VP of product design and now OpenAI's chief hardware officer, alleging they strategically extracted confidential information about Apple products.
