Berlin Court Restricts Law Firm's Statements on Xryma Plc
The Berlin II Regional Court has largely prohibited law firm Schirp from publishing statements about Xryma Plc related to the "Juicy Fields" case. The court found the firm failed to give Xryma an opportunity to respond to allegations.
Xryma Plc announced that the Berlin II Regional Court has largely ruled in its favor, issuing a preliminary injunction against the law firm Schirp Schmidt-Morsbach Rechtsanwälte. The injunction prevents the law firm from publishing most of the statements Xryma had objected to concerning the "Juicy Fields" affair.
The court's order prohibits Schirp from making or repeating claims that there were "sufficient grounds" or "suspicion" to hold Xryma responsible for investment fraud or money laundering. The firm had disseminated these allegations through various platforms, describing Xryma as a party involved in criminal activity. Violations of the order could result in fines up to €250,000 or imprisonment.
In its ruling, the court stated that Schirp had gone beyond permissible reporting by failing to give Xryma an opportunity to comment before publicly accusing the company. The court emphasized that law firms addressing the public are subject to press law principles and professional conduct rules.
Xryma Plc, a banktech group offering open banking services, confirmed that neither the company nor any of its executives or employees are subject to criminal investigations related to this or any other matter. The company stated it continues to cooperate with authorities investigating the "Juicy Fields" case.
