BFH ruling reclassifies sports club membership fees for VAT purposes

Germany's Federal Fiscal Court (BFH) has issued a ruling that could significantly alter the value-added tax (VAT) treatment of membership fees for sports clubs. In its decision (V R 4/23, dated November 13, 2025), the court determined that membership fees can be considered consideration for services provided by the club, departing from previous administrative practice.

The BFH has challenged the long-standing interpretation that membership fees were generally not subject to VAT. The court stated that this previous approach was contrary to EU law. The ruling has broad implications, affecting approximately 86,000 sports clubs in Germany with over 29 million members.

This new interpretation presents both potential risks and opportunities. Membership fees may become subject to VAT, potentially increasing costs for members. Conversely, clubs could gain the ability to deduct input VAT on investments, such as the construction of sports facilities. However, the complexity of VAT compliance will increase, particularly in distinguishing between taxable and exempt services.

Tax advisors, such as BDO AG, are urging clubs to review their current fee structures and future investment plans. While tax authorities have not yet officially updated their guidelines, an adjustment is anticipated. Clubs should analyze their statutes and services to identify both VAT risks and potential input tax deduction opportunities.
