Brazil –

The Court of Justice of Pernambuco (TJPE) has revoked interim appellate relief previously granted to Spribe OÜ in its ongoing legal dispute over the AVIATOR trademark in Brazil.

In the ruling, Justice Andrea Epaminondas Tenorio de Brito determined that the circumstances supporting the original injunction had changed significantly, rendering the legal grounds for maintaining the protection invalid.

The decision follows a previous ruling from the Federal Court in Brasília, which had temporarily suspended the legal effects of Spribe’s Brazilian AVIATOR trademark registration and sought to prevent Spribe's use of the mark. These actions were reportedly linked to claims that Spribe had used an earlier trademark in a manner that infringed on the rights of others.

This latest court order reduces Spribe's ability to protect its AVIATOR brand in Brazil, at least for the time being, and impacts the company's control over the game's name in the region.
