California utilities push for liability caps on wildfire damages

California utility companies PG&E and Edison are seeking to establish a legal cap on shareholder liability for damages resulting from wildfires ignited by their infrastructure. Reports indicate that representatives from the utilities are pressuring state legislators to pass the measure during a special session ahead of the Thanksgiving holiday.

Under the proposed terms, shareholder liability would be capped between $1.5 billion and $5.1 billion, regardless of total damages. For incidents such as the Eaton fire, where costs are estimated to reach up to $18 billion, the remaining financial burden would shift to ratepayers. Consumer Watchdog, an advocacy group, has criticized the proposal, arguing that it creates a moral hazard by capping the cost of negligence, potentially discouraging companies from prioritizing long-term safety investments.

Edison CEO Pedro Pizarro has stated that the legislative window for a special session closes in mid-November. While the utilities advocate for the urgency of the measure, rank-and-file legislators have expressed hesitation. Critics warn that fast-tracking such significant liability reforms outside of the standard legislative session avoids necessary public oversight and shifts accountability away from corporate entities.
