Class Action Filed for Residents Affected by Massive Gasoline Leak at Aston, Pa. Tank Farm

Law firms Berger Montague and Locks Law Firm have filed a class action lawsuit on behalf of affected residents against Monroe Energy, LLC and its subsidiary MIPC, LLC. The complaint alleges that the companies became aware of the leak in August 2025 but failed to disclose it to regulators or the public until December 2025. During this period, the lawsuit claims, the companies attributed increased activity at the site to routine maintenance and later described the incident to residents as an undefined "issue."
Environmental testing has confirmed the presence of gasoline-related toxic contaminants, including benzene, a known carcinogen, in soil, groundwater, monitoring wells, and indoor air of nearby homes. Over 100 monitoring wells have been installed, with dozens revealing measurable amounts of free-floating gasoline, including on residential properties.
Federal and state environmental agencies are investigating. The Pipeline and Hazardous Materials Safety Administration (PHMSA) issued an order requiring Tank 708, the source of the leak, to be taken out of service for independent testing. The Pennsylvania Department of Environmental Protection (PADEP) separately found that the operator unlawfully discharged petroleum, failed to provide timely notification, and handled gasoline in violation of its air quality permit.
The class action seeks compensation for property damage, diminished property values, environmental remediation costs, and medical monitoring for exposed residents. Claims include negligence, gross negligence, strict liability for an abnormally dangerous activity, public and private nuisance, trespass, and negligent infliction of emotional distress.
