CVS Caremark Settles FTC Litigation Over Pricing and Rebates

WOONSOCKET, R.I. – CVS Caremark announced on Tuesday a global settlement with the U.S. Federal Trade Commission (FTC), resolving all outstanding litigation and investigations related to the company's drug pricing, rebate, and contracting practices. The agreement aims to enhance transparency and affordability in prescription drug costs.

The settlement involves CVS Caremark implementing a series of actions into its standard offerings to commercial clients. These include aligning member cost-sharing more closely with net drug costs after rebates, simplifying pricing structures by moving away from rebate guarantees, and expanding transparency through enhanced reporting on drug pricing and member payments.

CVS Caremark will also expand affordability programs, introducing a new offering that caps members' insulin costs at $25 per month. The company stated that these measures are intended to pass more savings directly to consumers at the point-of-sale.

The company noted that many provisions in the agreement align with its existing initiatives. These include point-of-sale rebates and cost caps designed to reduce out-of-pocket expenses. CVS Caremark plans to continue working with regulators and industry partners to improve transparency and affordability within the pharmacy benefit system.
