Environmental group secures court ruling against Bayer over greenwashing claims

The German environmental organization Deutsche Umwelthilfe (DUH) has successfully sued the chemical company Bayer AG, securing a court order for the cessation of misleading consumer statements concerning the company's climate protection efforts. The Cologne Regional Court ruled against Bayer after the company failed to defend itself against the climate lawsuit filed by DUH within the stipulated timeframe, resulting in a default judgment.

Bayer had advertised its commitment to achieve "net-zero emissions" by 2050. However, according to the DUH's complaint, the company did not provide adequate details on how this goal would be achieved. While Bayer offered information on its plans until 2030, it failed to explain its strategy for full emission offsetting from 2050 onwards. Although Bayer amended its advertising after the lawsuit was initiated, it did not commit to refraining from such statements in the future.

Jürgen Resch, Federal Managing Director of DUH, stated that Bayer's "net-zero emissions" campaign constitutes "brazen greenwashing." He called on the "scandalous group" to reduce its significant ecological footprint through honest climate protection measures, such as ending glyphosate production, and to communicate transparently about its actions.

Agnes Sauter, Head of Ecological Consumer Protection and Market Monitoring at DUH, emphasized that companies like Bayer must provide comprehensible, concrete, and evidence-based measures to back up their future promises. She highlighted the importance of clear information regarding the extent of remaining emissions and how they will be managed, which is crucial for informed consumer choices and effective climate action.
