Epic Games Reapplies for "Megaverse" Trademark in Europe

Video game developer Epic Games has once again sought to register the "Megaverse" trademark in Europe. The company previously applied for the same trademark in 2022 for its metaverse-related ventures. However, the application was challenged by Megaverse Ltd., leading to a protracted legal dispute that ultimately favored Megaverse Ltd.

At the time, the court determined that simply adding "Epic Games" to the trademark was insufficient to create a distinct difference, particularly as "Epic Games" is the company's name, and consumers might distinguish between the company name and the specific trademark.

Epic Games has now submitted a new application for the "Megaverse" name, presented more directly than its previous "Epic Games Megaverse" filing. This new application covers several classes, some of which significantly overlap with Megaverse Ltd.'s existing trademarks, especially in class 9.

Megaverse Ltd.'s previously registered "Megaverse" trademarks remain valid in Europe. Consequently, the new application faces a potential challenge from Megaverse Ltd. The outcome hinges on the trademark examination process and any ensuing opposition proceedings.

While Epic Games' prior "Epic Games Megaverse" trademark is still active in the U.S., no corresponding new application for "Megaverse" has been recorded in the U.S. patent system. This latest European application suggests a focused strategy for the European market.
