EU Air Passenger Rights Updated, Effective June 2026
EU's air passenger rights legislation is set for significant updates effective June 2026. The reform aims to clarify rules and enhance passenger protection, with key compensation levels remaining unchanged.
The European Council and Parliament have agreed on a reform of air passenger rights, set to be implemented in June 2026. This update modernizes existing regulations, aiming to provide greater legal certainty for travelers, airlines, and enforcement bodies across the Union.
A key change mandates that airlines must proactively inform passengers of their rights within 96 hours of issues like flight delays or cancellations. The reform also introduces clearer procedures and easier access to necessary claim forms for passengers.
The definition of "extraordinary circumstances," which currently exempt airlines from compensation, will be tightened. This aims to limit broad interpretations by airlines that have previously circumvented compensation claims. Numerous European Court of Justice rulings will also be codified into law, simplifying enforcement.
Furthermore, transparency regarding baggage fees is improved, with standard cabin baggage, such as a small suitcase and a personal bag, now required to be included in the advertised flight price. Compensation amounts for delays and cancellations remain at €250 for flights up to 1,500 km, €400 for flights between 1,500 and 3,500 km, and €600 for flights over 3,500 km. Additional charges for seating families together are also restricted, with children under 14 having the right to sit next to an accompanying adult at no extra cost. Passengers cannot be compelled to download an app to obtain their boarding pass.
