Fanatics Wins Three Court Cases, One Antitrust Fight Remains

Fanatics, a major player in sports licensed merchandise and collectibles, achieved a significant legal win on Tuesday, with federal judges dismissing three antitrust lawsuits against the company. These victories address claims concerning both its established retail operations and its expanding trading card division.

The dismissed suits targeted Fanatics' licensed merchandise empire and its growing collectible trading card business. Chief U.S. District Judge Laura Taylor Swain of the Southern District of New York threw out all 13 counts. The lawsuits named Fanatics, its co-defendants including the NFL, NBA, MLB, their respective player associations, and OneTeam Partners, the commercial partner of the player associations.

Plaintiffs had alleged that the defendants conspired to monopolize the trading card market for the three major professional leagues and artificially inflate prices. The class-action suit, filed by 18 card collectors last year, claimed consumers paid inflated prices for NBA and MLB trading cards produced by Topps, a pioneering manufacturer acquired by Fanatics in 2022.

In her ruling, Judge Swain stated that the plaintiffs provided no market-wide analysis, data, or other evidence to support claims of supracompetitive pricing. She characterized the sources cited, such as Reddit threads and YouTube podcasts, as anecdotal experiences and opinions at best.

While Fanatics has navigated several legal challenges this year, these dismissals represent key successes. However, the company still faces one remaining antitrust battle against a key rival, indicating ongoing legal complexities in its market operations.
