Federal judge allows lawsuit against xAI over data center emissions to proceed
A federal judge has denied a motion by xAI to dismiss a lawsuit alleging that its Tennessee data center operates without proper air permits.

A federal judge has denied a motion filed by xAI to dismiss a lawsuit brought by the NAACP. The legal action alleges that the company failed to secure the necessary permits to operate the gas turbines powering its Colossus data center located near Memphis.
The Southern Environmental Law Center, representing the NAACP, claims that xAI installed and operated at least 35 combustion turbines at the site without obtaining the required pre-construction or operating air permits. The plaintiffs contend that these actions violate the Clean Air Act.
By allowing the suit to proceed, the court has paved the way for a deeper examination of the company’s compliance with local and federal environmental standards. The case serves as a point of contention regarding the regulatory hurdles associated with the rapid development of large-scale AI energy infrastructure.
