Federal Judge Rules Pentagon's Actions Against AI Firm Anthropic Were Unlawful

A federal judge has ruled in favor of artificial intelligence company Anthropic, finding that the Pentagon acted illegally and without basis when it designated the company a supply chain risk earlier this year. U.S. District Judge Rita Lin issued a written order Thursday night stating the government's actions were unlawful.

Judge Lin wrote that the government's actions "were based on a desire to make a public example out of Anthropic for its ‘arrogance’ in criticizing the government, not based on any articulable basis to believe that Anthropic would actually sabotage its model." The ruling further stated that neither the Constitution nor the federal statute invoked by the government allowed for "sweeping penalties based principally on Anthropic's critique of the Administration's views."

The dispute began in February when the government accused Anthropic of endangering national security and labeled it a supply chain risk. Anthropic CEO Dario Amodei opposed the designation, and the company sued the Pentagon in March, calling the government's actions an "unlawful campaign of retaliation" over its refusal to allow unrestricted military use of its technology.

The legal challenge has intensified a public debate over the use of AI in warfare and mass surveillance. OpenAI, a competitor to Anthropic, reached its own deal with the Pentagon shortly after Anthropic was punished. Both Anthropic and OpenAI are reportedly preparing for significant initial public offerings.
