Energy storage solutions provider Fluence Energy (NASDAQ: FLNC) is now the subject of a securities class action lawsuit. The legal action aims to represent investors who purchased or acquired Fluence securities between November 24, 2025, and September 16, 2026.

The lawsuit follows a series of unexpected earnings announcements that appeared to contradict Fluence's previous assurances about its ability to meet demand for data centers. These revelations have collectively erased approximately $3 billion from the company's market capitalization.

National shareholder rights firm Hagens Berman is investigating claims that Fluence violated federal securities laws. The complaint alleges the company failed to adequately disclose its inability to fulfill its backlog and recognize revenue, which depended on new contract facilities that were incomplete and non-operational.

The issues appear to be linked to problems at the company's Houston manufacturing facility, intended to ramp up production of thermal management systems. Recent disclosures in September 2026 led to another significant drop in Fluence's stock price. The company had previously reported delays and cost overruns related to both international and U.S. contract manufacturing facilities.
