Fogg Law Group, a Florida-based firm, recently secured a $2 million jury verdict for parents in a medical malpractice case following the stillbirth of their daughter. The verdict came after a week-long trial in Lee County, Florida, where the jury found in favor of the couple.
The lawsuit centered on allegations of misinterpreting a 20-week anatomy ultrasound. The ultrasound reading performed by Radiology Regional noted an inability to visualize the baby's face, nose, and lips. However, the interpreting radiologist later reported no facial or oral defects.
Plaintiffs argued that had the fetus's severe facial abnormality been identified during the scan, the mother's care would have been transferred from a midwife to an obstetrician, adhering to the standard of care. The mother developed preeclampsia at 38 weeks of pregnancy and delivered the baby stillborn. Post-delivery, physicians observed the child had a severe cleft deformity, which had not been diagnosed during the anatomy scan.
The defense attempted to attribute blame to the treating midwife throughout the trial. The jury's $2 million award to the plaintiffs underscores the gravity of the case and the preventable nature of the child's death, according to the law group.
