FuelCell Energy Faces Lawsuit Over Alleged Investor Misrepresentations
A class action lawsuit alleges FuelCell Energy, Inc. misled investors about its manufacturing capacity during the summer of 2026.

San Diego, CA โ October 1, 2026 โ Shareholder rights law firm Robbins LLP has filed a class action lawsuit against FuelCell Energy, Inc. The complaint alleges that the company misled investors regarding its manufacturing capacity between June 4 and September 1, 2026. FuelCell Energy designs, develops, and produces high-temperature fuel cells for clean electricity generation.
The lawsuit claims FuelCell Energy failed to disclose to investors that its manufacturing capacity was inadequate to meet the production rate required under a capital equipment purchase agreement (CEPA) with Fit Energy USA LP. This agreement was for up to 380 MW of fuel cell power for data centers. The complaint asserts that the company's production capacity could not sustain the necessary rate, leading to slower deliveries than anticipated.
Consequently, FuelCell Energy reported in September 2026 increased product costs and manufacturing overhead expenses that exceeded contractual pricing. The company recorded a $17 million charge related to provisions within the CEPA agreement. Following this news, FuelCell Energy's stock price fell by over 15%.
Robbins LLP is urging investors who suffered significant losses during the specified period to contact them for information on how to participate in the lawsuit. The deadline to potentially serve as lead plaintiff is November 10, 2026.
