National trial law firm Hagens Berman has alerted investors in FuelCell Energy, Inc. (NASDAQ: FCEL) to a securities class action lawsuit. The suit alleges that the company and its executives may have made materially false and misleading statements regarding its manufacturing capacity, production costs, and a significant contract with Fit Energy USA LP.

The lawsuit claims FuelCell Energy provided false and misleading information about its manufacturing capabilities and a contract to supply fuel cell systems for data centers. The company raised approximately $245.5 million through a stock offering around the time of the announcement.

The core allegations state that the company's actual manufacturing capacity was insufficient to meet the demands of the Fit Energy contract. Furthermore, production costs and manufacturing overhead exceeded contract pricing, leading to substantial losses. This came to light when FuelCell Energy reported a significant net loss of $45.3 million in September 2026, with increased gross losses partly attributed to the Fit Energy contract.

Following these disclosures, FuelCell Energy's stock price dropped by nearly 16%. Investors who purchased or acquired FuelCell securities between June 24, 2026, and September 1, 2026, and suffered significant losses, have until November 10, 2026, to seek appointment as lead plaintiff in the case.
