Germany's "Fourth Law to Relieve Citizens, Business and Administration from Bureaucracy," enacted on October 29, 2024, includes a provision that reduces the statutory retention period for booking receipts from ten to eight years. This measure is part of a broader effort to reduce administrative burdens on companies.

The new regulation applies to booking receipts whose ten-year retention period has not yet expired by January 1, 2025. However, companies subject to specific supervisory regulations, such as those under the German Banking Act (KWG) or insurance supervision laws, will adhere to their own distinct transitional rules.

It is important to note that not all business documents are affected by the shortened retention period. Commercial books, inventories, opening and annual financial statements, management reports, and related working instructions and organizational records must continue to be retained for ten years under § 257 Abs. 1 No. 1 HGB. Beyond reducing storage needs, this legal amendment may also lead to a decrease in provisions for the costs of maintaining business records, depending on materiality aspects.

BDO AG Wirtschaftsprüfungsgesellschaft, a German auditing and consulting firm, has highlighted this legislative change to assist businesses in understanding their updated obligations for document archiving.
