German Psychologists' Association Criticizes Planned ePA Data Access in Healthcare Law Draft

The Professional Association of German Psychologists (BDP) has voiced significant criticism regarding the German government's draft law for digital innovation in healthcare (GeDIG). The association has identified urgent needs for revision, particularly concerning the proposed access rights to data within the electronic patient record (ePA).

According to the BDP, the draft law includes provisions that raise concerns about the protection and security of highly sensitive patient data. A key point of contention is the proposed authorization for health insurance companies to access and utilize ePA data for various purposes, including research.

The BDP is also apprehensive about plans to expand the ePA app into a digital platform for initial assessments and appointment scheduling. The association argues that face-to-face, qualified psychotherapy consultations remain essential for initial assessments of mental health conditions. A mandatory digital approach for these first consultations could exclude individuals lacking access to necessary technology or the ePA app, thereby hindering or preventing their access to care.

The association advocates for restricting health insurance companies' access to sensitive ePA data. The BDP recommends relying on the existing national research data center (FDZ) for research purposes and calls for stricter data usage protocols and enhanced transparency for patients regarding data utilization. Robust data protection and clear access management are deemed crucial for maintaining public trust in the healthcare system.
