German publishers lobby EU to block Meta's new data crawling terms

Industry associations BDZV and MVFP have petitioned the European Commission to halt Meta’s planned policy changes, citing concerns over unauthorized mass-harvesting of digital press content.

1 November 2026

The German Association of Digital Publishers and Newspaper Publishers (BDZV) and the Association of Independent Media (MVFP) are formally challenging Meta’s upcoming update to its commercial terms, scheduled for October 30, 2026. The associations allege that the new provisions would allow Meta to automatically index, cache, and analyze entire digital catalogs, including paywalled articles, images, and archives, for use in its own commercial products.

Industry representatives argue that this move violates the Digital Markets Act (DMA), which prohibits gatekeepers from imposing unfair and discriminatory access conditions. The publishers contend that Meta is effectively forcing them to surrender their entire digital output as a prerequisite for maintaining their presence on Facebook and Instagram.

The publishers are urging the European Commission to intervene before the policy takes effect, arguing that once data is ingested into Meta's search indexes, vector databases, or AI training environments, it becomes impossible to track or purge. They characterize the practice as a form of non-consensual exploitation that threatens the economic foundation of the digital press.
