India's Digital Competition Bill Splits Tech Giants and Startups

India's proposed Digital Competition Bill (DCB) has exposed a deep divide between global technology giants and domestic startups. Companies like Google and Meta are lobbying for softer provisions, while over 40 Indian startups are urging the government to enact the bill swiftly. The legislation aims to introduce preventive regulations for dominant digital platforms.
Large technology firms voiced their concerns during consultations, accepting the principle of an ex-ante regulatory regime but requesting a clear appeals process for designation as a Systemically Significant Digital Enterprise (SSDE). They also seek India-specific evidence of market failures before preventive obligations are imposed, citing the EU's experience where similar rules allegedly had limited impact.
The DCB proposes a shift from the current ex-post enforcement model, where action is taken after anti-competitive conduct is proven. Under the proposed bill, authorities could designate large platforms as SSDEs based on financial, user, or qualitative criteria. These designated companies would face restrictions on self-preferencing, data combination, and app limitations without prior findings of abuse.
Startups, conversely, argue that ex-post enforcement is ineffective in digital markets and are advocating for the bill's passage. However, they worry the current proposals might unfairly impact smaller Indian firms. They are calling for higher thresholds for SSDE designation to ensure only the largest players are regulated, alongside a review mechanism and a dedicated digital regulator.
The bill's progression has been slow, with concerns raised by a parliamentary committee regarding regulatory clarity and enforcement capacity. The debate highlights the challenge of balancing the interests of global tech giants with the growth of local innovation, aiming for a competitive digital landscape in India.
