Instagram’s content restrictions in India face scrutiny over transparency

Instagram placed restrictions on a video posted by stand-up comedian Kajol Srinivasan in India, sparking concerns regarding the transparency of platform content moderation. According to Srinivasan, the platform initially restricted the reel, briefly restored it, and then restricted it again, citing general "Indian legal requirements" in automated notifications.

Reporting by Medianama highlights that the platform failed to disclose the specific legal provision or the government authority responsible for the action. This lack of transparency mirrors previous instances in India where content from journalists and cartoonists was similarly restricted, often using vague justifications linked to India’s IT Rules, 2021, or Section 79 of the Information Technology Act.

These regulations allow the government to request content removal or force platforms to act to maintain their legal immunity. However, the inconsistent nature of the notifications—some pointing to government notices and others to automated systems—has created confusion for content creators regarding their rights and the reasoning behind platform decisions.

Medianama has reached out to both Meta and India’s Ministry of Electronics and Information Technology (MeitY) for comment. As of now, the company has not provided a definitive breakdown of the legal mechanism triggered in this specific instance, leaving the exact status of the video and the motive behind the repeated restrictions unconfirmed.
