Investors Sue Hims & Hers for Misleading Statements and Data Sharing

Wolf Haldenstein Adler Freeman & Herz LLP announced it has filed a class action lawsuit against Hims & Hers Health, Inc. (NYSE: HIMS) on behalf of investors who purchased or acquired the company's securities between August 4, 2025, and July 29, 2026. The lawsuit alleges that throughout this period, the company made materially false and misleading statements and failed to disclose adverse facts to investors.

The complaint asserts that Hims & Hers shared consumers' health information with third-party advertising platforms. Additionally, the company is accused of charging consumers for prescriptions almost immediately after they submitted intake forms, despite assurances of consultation with a medical provider to find suitable treatment. The lawsuit also claims Hims & Hers made it difficult for consumers to cancel subscriptions and misled them regarding the privacy of their health information.

These alleged practices led to a lawsuit filed against Hims & Hers in July 2026 by the Federal Trade Commission (FTC), the State of California, and the Utah Division of Consumer Protection. The FTC's action specifically cited the company's alleged failure to clearly disclose immediate prescription charges and its sharing of health data with entities like Meta and Snap.

Following this news, Hims & Hers stock price fell by $4.32, or 14.73%, to close at $25.00 per share on July 29, 2026. Investors who purchased Hims & Hers shares during the class period and suffered losses are eligible to participate in the case. The deadline to be appointed lead plaintiff is November 2, 2026.
