Judge Rules Emails Criticizing ICE Actions Are Permitted

A federal judge has determined it is not illegal to send emails to Immigration and Customs Enforcement (ICE) officials informing them that their actions will haunt them. The ruling, issued Tuesday, grants a preliminary injunction that prevents ICE from threatening to prosecute an individual for exercising protected speech.

In January, David Streever sent a three-paragraph email to then-acting ICE director Todd Lyons. Outraged by the killings of two protestors against ICE in Minnesota, Streever called Lyons a "monstrous human being" who would "eat himself alive with shame" for defending officers who shot unarmed individuals posing no threat.

Streever compared Lyons to the infamous Nazi official Reinhard Heydrich and predicted that even Donald Trump would eventually turn on Lyons for defending the "obvious" killings of Americans. He stated that Lyons would never find peace and would torment himself until his last day.

The decision is a significant victory for free speech advocates concerned about government agencies attempting to silence criticism through threats of legal action. The judge's preliminary injunction ensures citizens can critique public officials without fear of prosecution.
