Justice Alito Recuses From Landmark Climate Case Over Investments

Supreme Court Justice Samuel Alito has recused himself from Suncor v. Boulder, a landmark climate deception case scheduled to open the court's new term. The decision comes after the consumer advocacy group Consumer Watchdog called for his recusal due to his investments in energy companies.

The court clerk informed the parties that Alito "has determined that he will not continue to participate in this case." While no official reason was given, the move follows a report by Consumer Watchdog detailing Alito's individual stock ownership in ConocoPhillips and Phillips 66. These companies have previously warned shareholders about the financial risks posed by climate lawsuits.

Consumer Watchdog's research indicated that every climate case currently stayed pending the outcome of Suncor v. Boulder names either ConocoPhillips, Phillips 66, or both as defendants. The organization argued that Alito's financial interests could create the appearance of bias, potentially affecting the public's confidence in the judiciary.

Justice Alito's recusal was announced one week before the Supreme Court begins its 2026-2027 term. The case, Suncor Energy v. Boulder County, is set to be the first heard by the court on October 5.
