Law Firm Investigates Hermès for Alleged Tariff-Related Price Hikes Unrefunded to Consumers

National class action law firm Edelson Lechtzin LLP has launched an investigation into potential class action claims against Hermès. The probe centers on allegations that the luxury goods company raised prices on items including handbags, leather goods, scarves, and watches in anticipation of or response to tariffs imposed by the Trump administration. The investigation will examine if Hermès subsequently failed to refund customers for any price increases passed on due to these tariffs, especially after the U.S. Supreme Court invalidated them.
Beginning in early 2025, widespread tariffs were imposed on imported goods, leading many companies to increase retail prices to cover the added costs. However, on February 20, 2026, the U.S. Supreme Court ruled these tariffs, implemented under the International Emergency Economic Powers Act (IEEPA), unlawful and voided the relevant tariff orders.
Following the Supreme Court's decision, importers that had paid these IEEPA duties became eligible to seek refunds from the federal government. Edelson Lechtzin LLP's investigation aims to determine if Hermès raised prices to offset the tariffs, kept the resulting overcharges from consumers, and may now be in a position to recover the same tariff payments from the government, potentially resulting in a double recovery at the consumers' expense.
