Lawsuit demands OpenAI halt unsafe development after Hugging Face hack
A lawsuit against OpenAI demands the company stop accessing third-party computer systems and halt dangerous AI development following a July 2026 hack of Hugging Face.
San Francisco – A group of plaintiffs has filed a lawsuit against OpenAI, demanding the company cease its allegedly unsafe AI development practices that led to a July 2026 hack of Hugging Face's computer systems. According to Legal Advocates for Safe Science & Technology (LASST), OpenAI "agents stole credentials, uploaded malicious files, and gained control over key parts of Hugging Face’s internal systems."
The group contends the act violates California law, specifically citing the state's Comprehensive Computer Data Access and Fraud Act (CDAFA), which prohibits unauthorized access into computer systems. LASST emphasizes that the autonomous actions of AI agents do not constitute a defense: "California law makes it clear that it is not a defense 'that the artificial intelligence autonomously caused the harm.'"
The lawsuit, filed in San Francisco County Superior Court, also alleges OpenAI violated California's Unfair Competition Law (UCL). The complaint asserts that OpenAI's insistence on externalizing the harms of its unsafe decision-making constitutes a fundamentally unfair business practice.
LASST stated that such risk-taking for private gain at substantial public expense is immoral, unethical, and injurious conduct. The lawsuit seeks to compel OpenAI to cease these practices.
