Lawsuit filed over Truth Social's paid access to Trump posts

President Donald Trump faces a lawsuit challenging Truth Social's monetization of his account, with plaintiffs arguing the practice violates the U.S. Constitution. The Freedom of the Press Foundation and The Intercept are suing, contesting the social media platform's decision to offer paid, "first-look" access to the president's posts for up to $100,000 per month.
The lawsuit asserts that this tiered access infringes upon the First Amendment's guarantee of equal access to presidential announcements and the Fifth Amendment's protection against charging unreasonable sums for government information. Seth Stern, chief of advocacy for the Freedom of the Press Foundation, criticized the arrangement as "blatantly corrupt and unconstitutional."
Truth Social's parent company launched the service, known as Truth API, to provide institutional traders and other select clients with immediate access to the president's posts. Company CEO Kevin McGurn has stated that multiple entities are already paying monthly fees ranging from $60,000 to $100,000.
The core of the legal challenge lies in whether a platform primarily controlled by the president can legally commercialize direct access to his communications. Trump's Truth Social account serves as a significant channel for his public statements, including policy declarations and official announcements, making the access issue a matter of public interest.
