The company's classification of these large-scale facilities as "experimental" allows it to apply for billions of dollars in tax reductions. This strategy utilizes a long-standing tax credit, originally intended to incentivize innovation by allowing businesses to claim credits for materials used in experimental research.

"Characterizing AI data centers as experimental is a rather bold and notable approach," commented Andre Shevchuck, a partner at BPM, a consulting firm specializing in R&D tax credits.

Concerns have reportedly been raised within Meta's own finance department regarding the legal standing of this strategy. The company has acknowledged in its securities filings that there is a considerable risk the IRS could challenge these tax credits, potentially requiring the repayment of billions of dollars.

This approach has yielded significant financial gains for Meta, with an estimated nearly $4 billion in tax savings reported for the past year. Public filings indicate Meta has become the largest beneficiary of this particular tax incentive among all publicly traded U.S. companies.
