Neuengörs Community Wind Farm Loses 6.6 Million Euro Lawsuit

The Neuengörs community wind farm has lost a lawsuit seeking 6.6 million euros in damages against Siemens-Gamesa. The Hamburg Regional Court ruled in favor of the manufacturer in late August, according to statements made by the wind farm's managing director, Jan Eike Schuldt, on Tuesday.

The legal action stemmed from an agreement for wind turbines that were not delivered. Consequently, the wind farm's shareholders purchased alternative turbines from another manufacturer. These replacement turbines were smaller and less powerful, resulting in financial losses for the shareholders due to reduced energy generation and revenue. The wind farm argued that Siemens-Gamesa should compensate for this shortfall.

Mr. Schuldt confirmed that the wind farm will not appeal the decision, citing the substantial legal and court costs already incurred, estimated to be between 300,000 and 400,000 euros. These expenses will be borne by the two operating companies of the wind farm.

According to Schuldt, attempts were made to reach a settlement during the proceedings, but Siemens-Gamesa rejected the proposed resolution. The core of the dispute involved the failure to deliver the agreed-upon wind turbines, which significantly impacted the community wind farm's operational revenue.
