New York imposes moratorium on new data center permits

New York has become the first U.S. state to implement a moratorium on new hyperscale data centers. Governor Kathy Hochul signed an executive order temporarily pausing state environmental permits for up to one year while regulators develop a new framework for the sector.

The order aims to assess the impact of large data centers on electricity demand, water resources, and local communities before additional projects proceed. The review will examine electricity consumption, water usage, air quality, and noise levels.

The directive applies to facilities that consume, or can consume, 50 MW or more of electricity. Exemptions are in place for facilities primarily used for manufacturing, research, education, and healthcare.

According to Medianama, Indian companies such as Google, OpenAI, and Meta have recently announced significant data center investments in India. New York's decision may signal a regulatory approach that other regions could consider as they seek to balance technology sector investments with community and environmental concerns.
