Nintendo Denies Customers Legal Right to Tariff Refunds
Nintendo has urged a court to dismiss a lawsuit demanding it pass tariff refunds to customers, arguing that purchasers of products like the Switch have no legal entitlement to funds the company is due to receive from the government.
Nintendo has informed a court that consumers who purchased its products, including the Switch console, do not possess a legal right to claim refunds that the company is expecting to receive from the government.
The company filed a motion to dismiss the case, stating that the plaintiffs are asking the court to "invent a legal duty out of whole cloth to retroactively re-price completed sales simply because the legal landscape has changed." Nintendo asserted that the plaintiffs "have no legal entitlement to the tariff refunds Nintendo stands to receive."
The lawsuit, filed in April, was initiated by two customers seeking to represent a class of U.S. residents who bought Nintendo products between February 2025 and February 2026. Plaintiffs Gregory Hoffert and Prashant Sharan alleged unjust enrichment and violations of the Washington Consumer Protection Act's prohibition on unfair or deceptive practices.
The outcome of this legal challenge could set a precedent for how businesses handle government-issued refunds and price adjustments in relation to consumer sales.
