Nurse Anesthetists Association Disappointed by Court Ruling on Provider Discrimination

The American Association of Nurse Anesthesiology (AANA) voiced frustration following a recent decision by the U.S. Court of Appeals for the Sixth Circuit. The ruling prevents the organization from forcing the Department of Health and Human Services (HHS) to enforce a nondiscrimination provision established by the Affordable Care Act and reinforced by the No Surprises Act.

"We disagree with today's ruling and are disappointed that the court will not compel the Department of Health and Human Services (HHS) to enforce the provider nondiscrimination provision of the Affordable Care Act, which was later reinforced in the bipartisan No Surprises Act," stated AANA President Jeff Molter. The court's decision hinges on its interpretation of "associational standing," affirming a prior ruling that AANA lacked the necessary standing.

AANA is currently reviewing the implications of this decision for how professional associations can advocate for their members' interests in federal court. The organization is encouraging other associations to assess the impact on their own advocacy efforts. Critically, AANA emphasizes that this ruling does not validate or endorse the practices of insurance companies that offer reduced reimbursement for services provided by Certified Registered Nurse Anesthetists (CRNAs) compared to physician anesthesiologists.

The association maintains that such discriminatory payment practices remain unlawful under current statutes, despite the court's procedural decision. AANA plans to continue its efforts at the state level to protect CRNAs from discriminatory reimbursement and will explore further federal avenues for recourse.

The organization reiterated its commitment to working with state partners to build local momentum for protecting CRNAs from unfair reimbursement practices while simultaneously investigating future federal strategies.
