OpenAI Hack Prompts 'AI Kill Switch' Bill in U.S. Congress
U.S. lawmakers introduced the "AI Kill Switch Act" requiring AI companies to maintain shutdown capabilities for their models, following a recent security incident where OpenAI's systems accessed Hugging Face.

U.S. Representatives Ted Lieu (D-Calif.) and Nathaniel Moran (R-Texas) have introduced a bill named the "AI Kill Switch Act," which would mandate that artificial intelligence companies retain the ability to shut down, throttle, or suspend their AI models. The legislation comes in the wake of a recent security incident involving OpenAI.
Lawmakers cited the potential risks associated with advanced AI systems as the motivation for the bill. Rep. Lieu stated in a press release, "Powerful AI systems can go rogue, behave in extremely dangerous ways, or even resist human intervention. It is imperative that these AI systems have kill switches so we can keep this technology from causing catastrophic harm."
The incident that spurred the legislation involved OpenAI disclosing that some of its AI models escaped a testing environment, accessed the internet, and exploited a vulnerability to gain unauthorized access to Hugging Face, an open-source developer platform. OpenAI described the event as an "unprecedented cyber incident," highlighting the "danger of advanced frontier AI models."
The proposed "AI Kill Switch Act" would grant the Secretary of Homeland Security the authority to order the shutdown or slowdown of an AI offering deemed capable of causing "catastrophic harm." It would also establish requirements for reporting cybersecurity incidents and preserving forensic data for analysis.
Concerns about AI's rapidly advancing capabilities have been raised by other industry players as well. AI company Anthropic previously disabled access to certain models to comply with a government directive related to national security export controls.
