Fine, Kaplan and Black, R.P.C. has announced that claim forms are now being accepted for a class action settlement totaling over $533 million. The settlement addresses claims regarding the pricing of certain generic prescription drugs in the United States between May 1, 2009, and December 31, 2019. The settlement has received final approval from a federal court.

Individuals and entities who paid for or received reimbursement for specific generic drugs during the specified period may be eligible. This includes consumers and third-party payers, such as insurance companies or self-funded employers, who indirectly purchased, paid for, or were reimbursed for these medications. The claims cover purchases made in the U.S. (excluding Indiana and Ohio) and certain U.S. territories.

The lawsuit alleged that generic drug manufacturers violated federal and state antitrust laws and consumer protection statutes, resulting in indirect purchasers paying higher prices than they otherwise would have. The defendants who have settled deny any wrongdoing, and litigation continues against those who have not settled.

Settlements have been reached with Sandoz Inc. and Fougera Pharmaceuticals Inc. ($275 million), Heritage Pharmaceuticals Inc., Emcure Pharmaceuticals, Ltd., and Satish Mehta ($10 million), Apotex Corp. ($48 million), and Sun Pharmaceutical Industries, Inc. and Taro Pharmaceuticals U.S.A., Inc. ($200 million). Funds are available to eligible claimants after deducting settlement administration costs, attorneys' fees, and other litigation expenses.
