Fine, Kaplan and Black, R.P.C. has announced that individuals who paid for or were reimbursed for certain prescription generic drugs in the United States between May 1, 2009, and December 31, 2019, are now eligible to submit claims for a collective settlement. The total value of the settlement is $533 million.

The lawsuit alleged that manufacturers of generic drugs violated federal and state antitrust laws, consumer protection statutes, and common law. The plaintiffs contend that this resulted in the "end-payers"—including consumers and third parties such as insurance companies or employers with self-funded prescription drug plans—paying inflated prices for specific generic medications.

As part of the settlement, Sandoz Inc. and Fougera Pharmaceuticals Inc. will pay $275 million. Sun Pharmaceutical Industries, Inc. and Taro Pharmaceuticals U.S.A., Inc. will pay $200 million. Heritage Pharmaceuticals Inc., Emcure Pharmaceuticals, Ltd., and Satish Mehta, along with Apotex Corp., have also agreed to combined payments totaling $58 million. All settling defendants deny any wrongdoing.

Eligible claimants must submit a claim form and supporting documentation by November 9, 2026. Claims can be filed online at www.GenericDrugsEndPayerSettlement.com or by mail. The amount of any potential payment will depend on the number of valid claims submitted and the amount each claimant paid for eligible generic drugs during the specified period.
