Traffic Violations Prescribe Later in Germany
German authorities will have longer to process traffic violations starting July 1. The statute of limitations for minor offenses will be extended.
Drivers in Germany will face a longer period during which authorities can pursue penalties for traffic violations. A new law taking effect on July 1 extends the statute of limitations for minor offenses, commonly known as "Ordnungswidrigkeiten."
The primary change doubles the standard statute of limitations from three months to six months. This means that authorities will have twice as long to issue fines or other penalties for violations such as speeding, illegal parking, running red lights, or using a mobile phone while driving.
The rationale behind the extension is to allow regulatory bodies sufficient time to process cases, as previously, many violations were not concluded before the three-month deadline expired. This change aims to ensure more violations are properly addressed.
Under certain circumstances, such as initiating an official inquiry or sending a notice of hearing, the six-month period can be interrupted and reset. The fundamental procedures for handling traffic violations and the penalties themselves remain unchanged.
