The Wendy's Company is in a legal dispute with Meritage Hospitality Group, a major franchisee that filed for Chapter 11 bankruptcy protection last month. The conflict centers on Meritage's plan to close at least 30 of its 314 Wendy's locations, with another ten stores slated for closure this weekend.

Wendy's attempted to intervene in the planned closures, proposing alternative locations for Meritage to shut down instead, and even offering to cover any losses incurred from such a swap. However, Meritage rejected the offer without providing a reason. Wendy's sought an emergency court hearing to address the rejection, but the request was denied, making the planned ten store closures likely.

The dispute highlights growing animosity between the fast-food giant and Meritage, a franchisee for nearly 30 years. Wendy's claims Meritage owes over $146 million in past-due royalties and fees, leading to a franchise termination notice. Meritage, in turn, has blamed Wendy's diminishing brand equity and aggressive discount promotions for its financial instability.

Wendy's stated that the closures related to bankruptcy proceedings are routine but has previously referred to Meritage as a "former" franchisee. The company's focus, a spokesperson said, remains on serving customers and strengthening the brand's long-term health. Meritage Hospitality Group did not immediately respond to requests for comment.

Wendy's stock has experienced a significant decline over the past five years, and the company is scheduled to report its third-quarter earnings on November 5. The outcome of this franchisee dispute could have implications for Wendy's operational strategy and brand stability.
