R+V Versicherung AG, a German insurance provider, has issued guidance highlighting the legal complexities and restrictions surrounding the use of drones for photography. The company emphasizes that while aerial shots offer unique perspectives, individuals must be mindful of privacy rights, data protection, and safety regulations.

The insurer's legal experts point out that photographing individuals without their consent can infringe on their right to their own image, especially if the images are published. This applies to drone photography as well. Exceptions exist when people are merely incidental to the main subject, such as being in the background of a prominent landmark. However, flying over crowds is generally prohibited for most private drones.

"Taking photos of private properties is generally forbidden without explicit consent from the owner," stated Sascha Nuß, a lawyer at R+V Versicherung. Unauthorized filming or photographing of individuals inside their homes using a drone can be considered a criminal offense. Furthermore, specific regulations govern the operation of drones over sensitive areas and infrastructure. For example, drones typically must maintain a safe distance from highways, railway lines, industrial facilities, and hospitals, with airports requiring a much larger exclusion zone.

Operators of drones, particularly those weighing over 250 grams or equipped with cameras, are required to register their devices with the German Federal Aviation Office. This registration assigns an electronic identification number for traceability. R+V strongly advises drone pilots to familiarize themselves with all applicable regulations before flight. Mandatory liability insurance is also required for all drone owners, with proof of coverage to be carried at all times.
